Surrogate mother

Surrogate motherhood is one of the ways to treat infertility - the inability to have children and the inability to continue their kind. To help a surrogate mother resort to cases of absence of the uterus or its deformation, with chronic diseases of the female reproductive tract, with numerous unsuccessful attempts to become pregnant.

Surrogate motherhood became possible due to the method of in vitro fertilization (IVF). The essence of the IVF procedure is to obtain maturing female eggs from the ovaries with further fertilization of the husband's spermatozoa. Legal regulation of surrogate motherhood in the world

In many countries of the world surrogate motherhood is prohibited. On the territory of Austria, Germany, Norway, Sweden, France and in some US states infertility treatment with the help of surrogate motherhood is considered illegal. In Belgium, Greece, Ireland and Finland, infertility treatment with the help of surrogate motherhood is not regulated by law, although it is applied. In most states of America, South Africa, Russia, Ukraine and Georgia, the use of surrogate mothers is prohibited only on a commercial basis. If the surrogate mother is willing to help for free, this does not contradict the law.

Surrogate mothers

A surrogate mother must meet certain requirements in order to use her services. The basic requirements for candidates are as follows:

1. Age from 18-35 years.
2. Presence of one or more own children.
3. Physical and mental health.
4. Lack of bad habits.
5. Absence of criminal past or convictions.

According to the surrogate motherhood program, in order to place surrogate mothers in the database of the Surrogate Motherhood Center it is necessary to undergo the following examinations:

• the delivery of an analysis for the determination of blood type and Rh factor;
• an examination with the therapist and a report on the state of health and the absence of contraindications;
• examination of and conclusions of a psychiatrist and an expert in narcology;
• ECG;
• fluorography;
• clinical and biochemical blood test;
• a blood test for clotting;
• blood test for syphilis, AIDS, hepatitis B and C.

The surrogate motherhood center gives the customer the opportunity to choose a surrogate mother from the database of the photo, taking into account individual wishes.

Surrogate motherhood contract

The surrogate motherhood contract must be concluded in writing and certified by a notary. Termination of the contract for surrogate motherhood is provided, if the surrogate mother intentionally violates the rules of the mode of bearing the child.

Surrogate motherhood problems are often associated with illiteracy drawn up by the contract. A competent contract should provide full protection for both parties, since there are cases when a surrogate mother, after giving birth to a child, refuses to give it to biological parents. In the Russian Federation, a surrogate mother has a legal right to do so, and in this case, biological parents are not reimbursed for damage and costs. In order for biological parents to get a child, a surrogate mother must write a child's refusal, and parents should take custody of him. In Ukraine and Belarus, biological parents are considered the legal parents of the child, and the surrogate mother does not appear in the documents.

There are also problems of surrogate motherhood related to blackmail of the surrogate mother of biological parents, there were cases when a surrogate mother threatened to smoke or drink alcohol if she did not get the right amount of money. Also there are failures of biological parents from the born kid and many other things.
